The cryptocurrency dilemma: regulation cannot be banned

  1. Background;

  2. The essence of the Federal Law No. 259 "On digital financial assets and digital currency" (hereinafter referred to as the Law on DFA);

  3. Arbitrage practice;

  4. Questions and suggestions.

Today, almost everyone knows about cryptocurrency. There is a debate about cryptocurrency, it is treated differently in different countries. For example, in India, quite recently, a bill was prepared, according to which it will be prohibited to own, issue, change cryptocurrency under threat of criminal liability, and in Japan, cryptocurrency is already 100% legal tender.

In this article, we will consider the legal regulation of cryptocurrency in Russia as of the end of March 2021.

1. Background

The attitude of government agencies (hereinafter referred to as government agencies) to cryptocurrency moves along the classic 5 stages of Kyumbler-Ross: denial, anger, bargaining (we are somewhere here now), depression and acceptance.

Negation

Despite the fact that the first cryptocurrency was issued in 2009 by a certain Satoshi Nakamoto, the Russian Federation did not pay attention to this phenomenon until 2014.

The Central Bank of the Russian Federation was the first to speak out , pointing out the high danger of issuing and exchanging cryptocurrencies and actually comparing these operations with the financing of terrorism.

Anger

Since 2014, the Prosecutor General's Office, together with the Central Bank of the Russian Federation, took up the fight against crimes that were committed through the use of cryptocurrency.

4. The methods of protection that the owner of the cryptocurrency can apply to the violator have not been determined;

5. There is no regulation of the activities of exchangers and other professional market participants for the storage, exchange, and issue of cryptocurrency.

More detailed regulation of cryptocurrencies and mining is currently at the stage of idea and development.

Due to the popularity of cryptocurrency technologies among Russians, we hope for the shortest depression period and further adoption of cryptocurrency in the legal field of the Russian Federation!
