What is digital law?



Digital law is a field of law that includes several branches of law at once and regulates relations related to IT. There are no separate sections in Russian legislation related only to the regulation of the digital environment, and these norms are dispersed according to different laws.



Digital law includes the regulation of relations in the field of IT projects, publishing information on the network, blockchain, personal data processing, big data, artificial intelligence and other areas. They overlap and complement others, and ultimately the scope of digital law expands as digitalization enters new areas of our lives.



Digital law legislation is constantly evolving (and not always for the better). For example, trends in cryptocurrency regulation in Russia range from “let's make our own state cryptocurrency” to “but let's ban all payments with cryptocurrency”. In the meantime, the Code of Administrative Offenses proposes to make amendments increasing the fines for personal data leaks, which usually occur when using electronic media. A few days ago, a bill was introduced to the government proposing to switch from paper business document flow to electronic one.



To keep up with what is happening in the field of digital law, you need to regularly monitor the news, read reviews of legislation and communicate with experts.



Why do you need to know digital law?



Most people are faced with digital law in their daily life, but entering into a legal relationship in this environment is usually unconscious, although it concerns many actions performed on the network and associated with digital services. Cybercrimes, privacy-related offenses and other events associated with the transition of many services and opportunities to the digital environment are increasingly occurring. Well, if you are just a user, then you need to know the basic legal norms in order, for example, to understand, for the publication of what information on the network you can be held responsible.



Digital law is important for those who launch projects in the IT field, own websites, and provide any services in the digital environment. When faced with all this, many people think about contacting specialists who are competent in the field of digital rights.



Many lawyers need to navigate digital law, as more and more legal relations are moving into the digital environment. Knowing the basic laws, concepts and practice of application in digital law is something that sooner or later may come in handy for every lawyer.



Where can you study digital law?



All these aspects are discussed in the classroom of the School of Cyber ​​Law. These are advanced training courses for lawyers in the field of digital law, which are conducted by the Digital Rights Center together with the Statute Law School and the Digital Rights Laboratory. The courses have state accreditation, and graduates receive a state-recognized certificate of professional development. This school provides basic knowledge of the basics of digital law.



There are not many lawyers in Russia dealing with digital law, as this is a new field of activity and most law schools do not even have such a training program. But in this area there are already recognized experts who have long been involved in IT law, were pioneers in this area and have a lot of practice. Among them are teachers of the School of Cyber ​​Law, for example, Mikhail Yakushev (member of the working group on Internet governance under the UN Secretary General), Sarkis Darbinyan (partner of the Digital Rights Center and co-founder of RosKomSvoboda), Nikolai Dmitrik (Head of the Laboratory of Legal Informatics and Cybernetics at Moscow State University) and other digital rights experts.
