You were fired from your job. Survival instruction

I am not an hr or a lawyer. I am an ordinary worker who has faced different situations and am learning to cope with them. I hope this text and my experience will help you.



In life, there are different things: they decided to lay off you, they found a cheaper employee in your place, or your views do not coincide with the views of the company. And now, you are informed that they decided to fire you.







Your task during this period is to get everything that you have earned, namely:



  • salary for days worked;
  • unaccompanied vacation pay;
  • compensation if you were fired / laid off.


But when we are fired, the ground leaves under our feet, we get lost and we are afraid. At times like this we feel most vulnerable. We also get angry because layoffs aren't always fair. In such situations, it is very easy for employers to save money on you. If you want to get what you want, you need to be brave and pull yourself together.



First, you need to understand what rights you have.



In order to be confident in your abilities, you need to know what you are entitled to by law. Such as:



  1. you must be notified 2 weeks in advance;
  2. upon dismissal, you must be paid compensation in the amount of at least 2 salaries.
  3. upon dismissal, you must be paid vacation pay and salary for the days worked.

The Code is good. But we all know that employers can skillfully circumvent the law. And most likely, you will not receive full compensation. Not everyone has the resources to fight the employer in court, but in order to protect themselves and get the most, there are a number of rules of thumb.



If you are officially employed, then you simply cannot be fired one day. You will be warned 2 weeks in advance and will most likely be asked to sign at your own request. So here's rule number 1:



If you don't quit your job, don't sign it yourself.



The employer only asks you to do this to save money. They are often frightened by the fact that the entry in the work book "fired" can negatively affect your career. But this is all nonsense. If you leave on your own, then you will not be paid a shisha - only working off for 2 weeks and vacation pay.



Do not sign any contract until you are told the exact amount of compensation.



From this follows rule number 2:



Specify the amount that you will be paid.



Okay, you didn’t agree to sign β€œon your own” and you even promised to pay money. But companies that pay money according to the scheme "part white - less, part gray - more" can pay you compensation under a white salary.





Let's say your salary is 80 thousand. Of these, 50 are gray and 30 are white. Do you see where I am leading?



You may be promised that you will be paid both vacation pay, salary and compensation. You count on a certain amount and sign the paper. And on the day of payment, you receive an amount 3 times less.



Do not sign the papers until you are clarified and prescribed the exact amount of payment. In some cases, you can even agree to sign the papers only after the entire amount has been paid.



Rule number 3: talk to your dismissed colleagues.



Surely there are rumors in your company about an employee who was fired. Write to this person and if he does not mind, ask how he was fired and whether everything was paid. In such a conversation, you can find out about the tricks that hr goes to so that the company pays you as little as possible.



But what about those who work informally?



If you are fired from your official job, it's not so bad. A real headache in informal jobs.



You need to start even before you leave, while you are working, collect all the evidence of your employment: contracts, NDA, corporate letters, and so on.



From such a job, you can be fired one day and in most cases they will. And if you are not paid money, then I know only 2 ways to get your money:



1 - Persistently ask for money. If you call / write to the employer 2 times, it will not help. In some cases, you have to call several times a day. And in some to come to the office. This can help.



2 - If after weeks of calls you are not paid - go to the labor inspection. They will help you there.







By the way, about the labor inspection. Many workers are recording the conversation with HR on a dictaphone. In some cases, this helps. And in some, the company's lawyers can disarm you. The fact is that in some cases such a recording can be made illegal if you did not warn about the recording in advance.

Do not provide your personal information and do not pay money to anyone. For example, these dishonest people take money, say that the victory is 100%, but in the end they do nothing.
